Split verdict on Guj Lokayukta appointment

In Gujarat, the division bench of the High Court has pronounced a split verdict over the appointment of the Lokayukta in the state by the Governor. The Bench was divided on the appointment of Justice RN Mehta as the state Lokayukta.

Justice Akil Qureshi upheld the appointment and Justice Sonia Gokani indicated that she does not fullly agree with him. The Narendra Modi Government had challenged the appointment in the High Court. The main argument against Justice Mehta's appointment was that the move undermined the federal character of the Indian state as enshrined in the Constitution. It has been argued that the governor appointed the Lokayukta without the aid and advice of the Council of Ministers.

Our Ahmedabad Correspondent reports that second Judge of the bench, Justice Sonia Gokani will pronounce her full judgement today. It is also likely that the matter may be referred to a larger bench of the High Court or the Chief Justice of the High Court. With the splict verdict, the tussle between the Gujarat Governor Dr.Shrimati Kamala and Chief Minister Narendra Modi over the Lokayukta remained unresolved as of now.
