SC to hear together AAP govt's civil suit seeking statehood for Delhi and its petition against HC order

The Supreme Court will hear together the Delhi Government's civil suit seeking statehood for Delhi and its petition against yesterday's Delhi High Court order.<br/><br/>This was stated by a bench of Justices A K Sikri and N V Ramana today after Delhi government informed the apex court that it will file an appeal shortly against yesterday's verdict. <br/><br/>As AAP government's earlier suit seeking a declaration that the national capital is a state, came up for hearing, the court said that instead of pursuing its earlier civil suit, the city government should file an appeal challenging the Delhi High Court's decision.<br/><br/>Holding that Lt. Governor is the administrative head of National Capital Territorry, the High Court had rejected the AAP government's contention that LG is bound by the advice of council of ministers. <br/><br/>The court had said that the special constitutional provision Article 239AA dealing with Delhi does not "dilute" the effect of Article 239 which relates to the Union territory and hence, concurrence of the LG in administrative issues is "mandatory".
