SC to give open court hearing for curative petition challenging gay criminalisation

Supreme Court today agreed to consider the plea for giving open court hearing on curative petitions filed by LGBT rights activists challenging criminalisation of gay sex.

Naz Foundation,an NGO fighting for gay rights had filed a curative petition in the Supreme Court requesting it to correct its verdict criminalising gay sex and made a plea for open court hearing enabling them to advance oral arguments. The petitioners contented that there is an error of law as the judgement criminalising gay sex was based on an old law.

In January 2014, the apex court in its in-chamber proceedings, had dismissed a bunch of review petitions filed by the Centre and gay rights activists against its December 2013 verdict declaring gay sex an offence. With the dismissal of review plea, the petitioners were left with only one option to get relief – by filing curative petition.

The Supreme Court had on December 11 2013 set aside the Delhi High Court judgement decriminalising gay sex.
