SC dismisses Delhi govt's plea seeking death penalty for killers of Nitish Katara

The Supreme Court today dismissed the Delhi government's plea seeking death penalty to the three convicts in the Nitish Katara murder case. A bench of justices JS Khehar and R Banumathi said, the case did not fall under the rarest of rare category warranting the extreme penalty. The court, however, said it will be needing the assistance of Delhi government's lawyer in deciding the petitions filed by the three convicts on the limited questions as to whether the high court was justified in awarding jail term of 30 years to them.

Last month, the apex court had rejected the plea of the Nitish Katara's mother, who had also sought death penalty for the convicts.

Vikas Yadav, son of Uttar Pradesh politician DP Yadav, his cousin Vishal Yadav and Sukhdev Pehalwan are serving life term awarded to them by the lower court in 2008 for abducting and killing Katara, a business executive, in 2002. The accused had opposed the victim's relationship with Bharti Yadav, Vikas and Vishal's sister. The bench has posted the matter for final hearing in February next year.
