The Delhi High Court has upheld the Government's decision to extend the tenure of Prasar Bharati CEO B S Lalli and said he can continue till he completes five years in office. A Bench comprising Chief Justice A P Shah and Justice S Muralidhar dismissed a PIL filed by an NGO, Centre for Public Interest Litigation (CPIL), which had contended that Lalli's continuation in office was illegal.
The court accepted the contention of the Central Government which had pleaded that an amendment brought in to increase the upper age limit for the post from 62 to 65 is applicable to the incumbent CEO. Mr. Lalli was appointed as CEO of Prasar Bharati on December 26, 2006 for a period of six years or until he attains the age of 62 years whichever is earlier. Mr.Lalli was due to retire in April this year after attaining 62.
The Centre, in the meantime, brought an amendment in the Prasar Bharati Act in April last year and increased the retirement age to 65 while the maximum tenure was decreased to five years from six years.
Dismissing the NGO's contention, the High Court held that Mr.Lalli's tenure is covered by the amendment.
