PIL seeks uniform protocol for forensic medical examination in sexual assault cases

The Nagpur bench of the Bombay High Court has issued notices to the Centre as well as the Maharashtra government over a PIL seeking uniform protocol for forensic medical examination in cases of sexual assault.<br/><br/>It also called for special training to doctors in collection and recording of medical evidence in such cases. <br/><br/>The petitioners — Child Welfare Committee chairperson Ranjana Pardhi and advocate Vijay Patait have contended that very often culprits in sexual assault cases are acquitted because of faulty collection of medical evidence and incorrect reports. <br/><br/>The division bench of Justices A P Lawande and P D Kode admitted the petition and asked the ministries of Health and Law and Judiciary of both the Union and the state governments to file their replies in four weeks. <br/><br/>The petitioners have demanded that doctors and para-medics be trained in special forensic examination of rape victims and accused as per WHO guidelines. The PIL said, even the Supreme Court had expressed anguish over lack of proper medical evidence of sexual assault which leads to acquittals.<br/>
