Parliamentary Committee suggests separate Director of Prosecution in CBI

A Parliamentary Committee has suggested a separate Director of Prosecution in the CBI under Lokpal. The Select Committee of the Rajya Sabha on Lokpal and Lokayuktas Bill 2011, also recommended that the Lokpal will have the power of superintendence over CBI in cases referred to it. The Report of the Committee, tabled in the Upper House today, said CBI Director will remain head of the entire organization. Both the Directors will have a fixed term of two years. It said CBI officers investigating Lokpal referred cases are not to be transferred without the approval of Lokpal. The Prime Minister has been exempted from the ambit of Lokpal on issues of external and internal security, atomic energy, international relations and public order.

The Committee, among other things, also recommended the delinking of creation of Lokayuktas in states from the central bill. Later, briefing the media, Committee Chairman Satyavrat Chaturvedi said it has recommended that Prime Minister, Lok Sabha Speaker, Leader of Opposition in the Lok Sabha and Chief Justice of India or his nominee, will recommend the name of the 5th eminent person as a member in the Selection Committee for Lokpal.

AIR Correspondent reports that the Lokpal and Lokayuktas Bill 2011, was passed by the Lok Sabha on 22nd of December 2011. On the 21st of May 2012, the Rajya Sabha adopted a motion to refer it to a 15-member Select Committee for examination. The Committee held 19 sittings and adopted the report on 19th November 2012.
