Parliament has passed the Industrial Disputes (Amendment) Bill, 2010.It was approved by the Lok Sabha today .The bill provides for a workman to approach labour court after 45 days of his dismissal without reference from appropriate government, Centre or state. The bill was earlier passed by the Rajya Sabha.Winding up the debate on the Bill,Labour Minister Mallikarjun Kharge said,during the conciliation period, people used to indulge in delaying tactics. Now the period be reduced to 45 days. The original Bill had provided for a three-month waiting period for filing of complaint by a dismissed worker. But, it was reduced to 45 days on the recommendations of the Standing Committee.The Bill, which seeks to amend the Industrial Disputes Act, 1947, also provides for establishment of a grievance redressal machinery in every industrial unit employing 20 or more workmen.According to the bill, a person receiving up to 10,000 rupees per month would be treated as workman under the new provisions. At present, the limit is 1,600 rupees a month.Initiating the discussion on the Bill, Paban Singh (Cong) said, around 90 per cent of the establishments have not constituted grievances redressal committees which hear labourers complaints.He also said while workmen at public ports are well protected, the government should ensure similar benefits and protection to those working at private sector ports.Supporting the bill, Virendra Kumar (BJP) said these amendments should have been brought much earlier.He said around 75,000 cases are pending under the Act. Prabodh Panda (CPI) asked the Labour Minister how the labour laws could be simplified. Arjun Charan Sethi (BJD) said the particular piece of legislation should have been brought earlier.Shailendra Yadav (BSP) and Hansraj Ahir (BJP) also participated in the debate.
