The Central Administrative Tribunal (CAT) has held that non-performance of a government employee due to leave on health grounds cannot hamper his promotion. <br/> <br/>The tribunal said that annual confidential reports (ACRs) on the basis of which promotions are decided should not include the duration during which an employee does not work due to health problems. The tribunal passed the order on a plea of a CPWD Chief Engineer who was denied promotion on the ground of below benchmark ACRs for the period when he was hospitalised for liver transplantation. <br/> <br/>The tribunal directed the CPWD to re-consider his promotion by ignoring his ACRs for the two years which were below benchmark, while noting that the petitioner had performed excellently in the rest of the period.<br/>
