Nepal’s Supreme Court has ordered the resumption of services within twenty hours and ordered the stakeholders to end the strike at the Bharatpur Cancer Hospital in Chitwan. The single bench of Justice Baidhya Nath Upadhayaya issued the order on Tuesday, after the hearing on the writ petition filed by the Consumers’ Rights Protection Forum against the Ministry of Home Affairs, Ministry of Health and Population, Office of the Prime Minister and Council of Ministers, and the incumbent Executive Directors of the hospital and the Chief Medical officer of Chitiwan. The court has also ordered to furnish written explanations on the closure within fifteen days. Following a two-month long dispute over the appointment Dr. Laxmi Narayan Singh as the new executive of the hospital to replace Dr. Bhakta Man Shrestra , the BP Koirala Memorial Cancer Hospital staff have brought the regular services to a grinding halt since 28th of April. This is the largest cancer hospital in Nepal.The petition was filed in line with the Interim Constitution -2007, Essential Service Act -1957 and Consumers’ Protection Act -1998, which has prohibited strikes and protests in sensitive areas related to public service such as hospitals as these services must be easily accessible to each and every citizen at all times.
