The Nagpur bench of Bombay High Court has directed the State Government not to allow entry of vehicles carrying toxic waste of the Union Carbide plant into Maharashtra. Nagpur Municipal Corporation has also been directed to prevent entry of such hazardous substances within the city limits as a matter of abundant precaution. The Division Bench consisting of Mr. Justice Bhushan Dharmadhikari and Mr. Justice Pramod Kode issued these directives while hearing a Public Interest Litigation opposing the dumping of toxic waste lying at Bhopal in Nagpur and its disposal at the facility of Defence Research and Development Organisation at Butibori near Nagpur.The petition was filed following order of the Madhya Pradesh High Court directing disposal of the 346 tons of toxic waste at DRDO facility near Nagpur and its immediate transportation by the Madhya Pradesh Government. While issuing notices to the Union Government and Government of Maharashtra and Maharashtra Pollution Control Board, the Division Bench directed the respondents to file reply within 48 hours and also made it clear that the respondents would have to approach the M. P. High Court in order to seek further relief.
