Notification for delimitation The Madras High Court on Thursday dismissed a batch of writ petitions challenging Presidential Notification for delimitation of council of constituencies for a Upper House in the state.Tamil Nadu Assembly had passed a resolution for creation of a Legislative Council in the state and a bill in this regard was also passed by the Lok Sabha.On September 30, a Presidential Notification on delimitation of council constituencies (Tamil Nadu) Order-2010 was issued.A writ petition seeking to declare it as unconstitutional was earlier was also dismissed by the High Court.Later, 13 writ petitions were filed challenging the Presidential Notification.The petitions said delimitation order was in contravention of Representation of Peoples Act-1950 and it was ineffective without prior approval of the Parliament and therefore liable to struck down as unconstitutional, null and void.Dismissing the writ petitions as not maintainable, a divison bench comprising Chief Justice M Y Eqbal and Justice T S Sivagnanam said the petitioners have not made out a case.
