Lok Sabha takes up bill on Commercial Courts for discussion

The Lok Sabha today took up the Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Bill, 2015 for further discussion. The Bill enables the creation of commercial divisions in High courts and commercial courts at the district level. It also proposes to set up Commercial Appellate Divisions in all High courts to hear appeals against the orders of commercial divisions of High Courts, commercial courts and appeals arising from arbitration matters that are filed before the High courts.<br/><br/>As per the proposed legislation, suits currently pending in the district courts with a value of one crore rupees or more would be transferred to the commercial courts. However, a suit will not be transferred if a final judgment on the matter is pending. Participating in the debate, B Senguttuvan of AIADMK supported the Bill saying that the commercial courts will help expediting the disposal of pending cases. He also pitched for filling up the vacancies of judges in various courts. He also urged the government to provide more funds to States for providing adequate infrastructures in such courts. <br/><br/>Kirti Azad of BJP expressed concern over of the vacant posts of judges in various courts and urged the government to fill up them at the earliest. Mr Azad said, there is a need to strengthen the judicial system for speedy disposal of pending cases. He also demanded to conduct Indian Judicial Services for recruitment of judges in lines with Civil Services Exam. Arpita Ghosh of TMC said that time bound judgements are essential for speedy disposal of cases. Tathagata Satpathy of BJD demanded the bill to be referred to Standing Committee for further scrutiny.
