The Kerala High Court today directed Air India to pay a compensation of 75 lakh rupees to the family of a victim killed in the air crash at Mangalore Airport in May last year. Disposing of a petition filed by the family members of Mohammed Rafi who was killed in the mishap, Justice P.R. Ramachandra Menon directed the airline company to pay the compensation within one month, deducting the advance payment effected already. The court said, the petitioners are not liable to be discriminated by the airline company restricting the compensation with reference to age, income or dependency of the members of his family. It said, the matter should be treated as 'No Fault Liability' under the Montreal Convention which can in no case be absolved or limited by the carrier under any circumstance. The air crash involving the Mangalore-bound Air India Express flight from Dubai took place on May 22 last year killing 158 persons on board while landing at the Mangalore Airport.
