Kerala HC refers writ petition on Idukki DC's notice to Green Bench

A single bench of the Kerala High Court today referred to the Green Bench a writ petition filed by the Kannan Devan Hill Plantations company challenging the Idukki District Collector's notice to it to demolish two check dams in its estates. <br/><br/>Justice T R Ramachandran Nair in his interim order directed the government not to effect the demolition of the check dams for a period of three weeks. <br/><br/>Stating that the writ petition is maintainable, the Court said the notice by the District Collector is prima facie without jurisdiction. <br/><br/>The Court noted that the clause that prior permission is required for constructing dams as per the 2003 Kerala Irrigation and Water Conservation Act, will not be applicable for the check dams in the estates, which had been in existence for the past 70 years.<br/>
