The Kerala High Court today reserved its orders on a petition seeking the quashing of FIR registered in connection with the killing of two fishermen by Italian marines on board the vessel, Enrica Lexie. The Kerala Advocate General K P Dandapani opposed the petitioner's claim on functional immunity and added that the duo did not enjoy such an immunity as they were not discharging any sovereign duties.The petition seeking to quash the FIR was moved by the two Italian marines who shot dead the fishermen and the Consul General of Italy in Mumbai. The Italians had argued that the incident occurred outside India's territorial waters and hence should be tried in Italy, and that the marines enjoyed functional immunity.
