Karnataka HC upholds disqualification of 11 BJP MLAs

Karnataka High Court has upheld the action of Assembly Speaker K G Boppaiah disqualifying 11 BJP MLAs for anti party activities. The third judge – Justice Sabhahit – pronouncing the Judgement said he concurs with the view held by Chief Justice J S Khehar that the disqualified MLAs have acted against the party by submitting to the Governor the letter of withdrawal of support to the Government.The two judge bench of Chief Justice J S Khehar and Justice N Kumar had earlier held divergent view and the case transferred to the third Judge Justice V G Sabhahit. The writ petition was filed in the Karnataka High court when Speaker K G Bopaiah had ordered disqualification of 11 BJP and five Independents on October 10 on the eve of the first floor test faced by B S Yeddyurappa. The case pertaining to five Independent MLAs is listed before the new bench of the High Court on November 2.
