Karnataka High Court today resumed hearing on the petitions by 11 rebel BJP MLAs challenging their disqualification from the Assembly. They were disqualified by the Speaker of the Assembly K G Bopaiah on 10th October after their withdrawal of support to the B S Yeddyurappa Government.The third judge, Justice V G Sabhahith today heard the arguments on behalf of the state government submitted by former Attorney General Solisorabjee in the court. The disqualification of 11 BJP MLAs by the Speaker was defended by him saying that the Speaker has drawn inference from the conduct of the rebel legislators. He explained that the actions and negotiations of legislators, prior and after the letter was submitted to the Governor withdrawing their support to thegovernment, clearly indicate their intentions.The lawyer on behalf of the disqualified MLAs concluded his submission to the Court this morning. After lunch the hearing will continue.Earlier yesterday, Justice Sabhahith had adjourned hearing on the petitions after inconclusive arguments. The Judge is hearing the petitions after a division bench delivered a split verdict with Chief Justice J S Khehar upholding the Speaker's order and Justice N Kumar setting it aside.Along with the 11 MLAs and five independents were also disqualified by the Speaker a day before the trust vote sought by Yeddyurappa. The petition by five independent MLAs would be decided by a new division bench on 2nd of next month.
