Karnataka HC reserves verdict on expulsion of five independent MLAs

The full Bench of Karnataka High Court, which took up the matter related to additional applications related to disqualification of five Independent MLAs, has reserved its judgement for Monday.The Petitioners had filed four additional applications on two writ petitions and sought the permission of full bench to allow them. The respondents on behalf of the Government , however, argued that these applications are not maintainable and liable to be dismissed as they are not in accordance with the provision of the law. The additional applications were filed to implead the Chief Minister as a party to the case and also made additional charges against the Speaker. Hearing the argument on both sides, the Bench comprising of Justice Mohan Shantanagoudar, Justice S. Abdul Nazeer and Justice A.S. Bopanna reserved their Judgement, on whether to allow the additional applications or not. The main writ petition on disqualification will be taken up thereafter. The five Independent MLAs were disqualified by the Speaker K G Boppaiah on the ground that by withdrawing support to the Government and submitting a letter to the Governor, they have indulged in anti party activities. The case is fought under the provisions of 10th Schedule of the Constitution, commonly called as anti defection Law.
