The Karnataka High Court today adjourned the final hearing on a petition filed by five independent MLAs challenging their disqualification from the membership of the Legislative Assembly. The adjournment came following the Supreme Court asking the lower court to defer the hearing till further orders and issuing notices to them on a petition seeking stay of the November 15 High Court order, allowing them to amend their petition. After asking the High Court to defer hearing, the Supreme Court on last Friday posted the matter for hearing on December 2.The bench of the High Court gave no date for the next hearing, observing that they do not know when the matter will be closed by the Supreme Court. Earlier, the full Bench of Karnataka High Court had allowed the five disqualified MLAs to submit main writ petition comprising of all amendments, additional impeding and additional grounds and had posted the hearing for today. The amendment to the petition was sought by the Independent MLA’s lawyers as the original application submitted to the court had mentioned by mistake that Independent MLAs are part of the BJP party instead of not being part of the BJP party. The five Independent MLAs were disqualified by the Speaker K G Boppaiah on the ground that by withdrawing support to the Government and submitting a letter to the Governor, they indulged in anti party activities.
