<br/>The International Criminal Court has ordered the release of Congolese warlord Thomas Lubanga Dyilo. Thomas has been charged with war crimes for recruiting and using children as soldiers in Congo's civil war in Ituri Province. Proceedings against him were suspended last week when the defense accused the prosecution for not indentifying a key witness. <br/><br/>The court, while announcing the decision said, Thomas cannot be held in preventative custody on a speculative basis. Though the court maintained that at some stage in the future the proceedings may be resurrected. Thomas surrendered in 2006 and was the first person to go on trial at the ICC. He has pleaded not guilty.
