Delhi High Court has observed that if telecom operators are compelled to compensate consumers for call drops as per the new TRAI regulations, they will not be able to recover it if the rule is set aside in future.

A bench of Chief Justice G Rohini and Justice Jayant Nath also said, it does not appear that Telecom Regulatory Authority of India has considered the objections raised by the cellular operators against its compensatory regulation. The bench, however, agreed with TRAI that the regulator has the power to make the present regulation.

Appearing for TRAI, Additional Solicitor General PS Narasimha said all the representations of telecom firms were considered before the rule was made. He also said the rule was formulated in order to ensure that the telcos invested more and provide better service to consumers.

According to a 16 October notification by the TRAI, telcom firms must credit 1 rupee to a user for every call that ended abruptly due to poor mobile signal, subject to a maximum of 3 rupees per day. Telcos are contesting this.
