The Delhi High Court has upheld telecom regulatory body TRAI's decision making it mandatory for telecom operators to compensate subscribers for call drops. A two-Judge bench today dismissed a batch of petitions filed by Cellular Operators Association of India saying that TRAI has liberty to implement its regulation that came into effect from January 1st, 2016 as per the notification.

The bench observed that there is no dispute about the power of TRAI to make the regulation, keeping in mind the paramount interest of the consumer. It also said, the compensation for call drops is capped at only 3 rupees per consumer. The regulation also mandates only compensating the calling consumer not the receiver, the bench added. The telecom operators had moved the court contending that the TRAI regulation was a knee-jerk reaction which penalised them without proving any wrong-doing.
