The Allahabad High Court has directed the principal secretary home and I.G Prison of Uttar Pradesh government to provide a list of such prisoners who were entitled to benefit under section 436 A of the Cr PC. The section 436A provides benefits to prisoners in cases other than the case where death sentence is provided.

]According to law during the investigations or trial if prisoner has undergone detention up to half of the maximum period of imprisonment specified for the offender should be released by the court on his personal bond.

Passing this order the high court bench comprising Justice Amar Saran and Justice Kalaimullah Khan observed that despite provisions several prisoners are languishing in jail in Uttar Pradesh.

Giving four weeks time for reply the court said that list is required so that the Court may issue appropriate directions for the benefits of prisoners.
