HC relief for UP male gynaecologists

In Uttar Pradesh, policy of exclusion of male doctors while making selections for posts of gynaecologists in provincial medical and health services has been termed as illegal, irrational and violative of the Constitution by the Allahabad High Court.A Division Bench of the court comprising Justice Sunil Ambawani and Justice Kashi Nath Pandey passed the order to this effect on a writ petition moved by a qualified doctor opposing the said policy of recruitment of state government. The petitioner had also prayed for quashing of the discriminatory advertisement floated by State Public Service Commission on May 23 of last year.The court also directed the state government to either bifurcate the posts of gynaecologist with specialisation in Obstetrics and Gynaecology in the specialist sub cadre of male and female or to allow preference on such posts for women in such a manner that it may not result in total exclusion of male doctors specialising in obstetrics and gynaecology. The court also directed the Public Service Commission to interview the petitioner for the post and if he is found eligible, qualified and suitable shall be recommended and appointed in the batch.
