HC declares JD (U) MP’s election void

The Patna High Court today set aside the election of Mangani Lal Mandal, suspended JD (U) MP, from Jhanjahrpur Lok Sabha constituency in Bihar.Justice V N Singh declared Mandal's election as void after hearing a writ petition filed by Vishnu Deo Bhandari.In his petition, Mr. Bhandari had claimed that Mandal had not made full disclosures in the affidavits filed while seeking election from Jhanjharpur in 2009 elections, required under the Representation of People's Act (RPA).The counsel for the petitioner had placed before the court a copy of the affidavit filed by Mandal before Election Commission in which he has deliberately concealed the fact that he had two wives.This amounted to flagrant violation of the RPA and hence his election is set aside.In course of the hearing, the court found out that Mandal had a first wife who also owns property.In the light of deposition of witnesses and the established facts, the election is being declared void”, Justice V N Singh ruled.Mandal was recently suspended from the JD (U) for his alleged anti-party activities during the 2010 assembly elections.
