The Gujarat High Court has asked the Nanavati Commission, probing the 2002 riot cases, to clarify by April 1 whether it will summon Gujarat Chief Minister Narendra Modi in the matter. A division bench of Chief Justice S J Mukhopadhaya and Justice Akil Kureshi sought this information from the government pleader while hearing an appeal by Jan Sangarsh Manch, an NGO representing the 2002 riot victims. Nanavati Commission, in September last year had disposed of the application of Sangarsh Manch asking for summoning of Modi and others saying that it did not find justification in cross-examining them.<br/><br/>The High Court direction comes a day after Mr Modi failed to appear before the Special Investigation Team -SIT in Ahmedabad. He was summoned by the SIT in connection with a Gulbarg massacre case in post-Godhra riots in 2002.<br/><br/>Special Investigation Team- headed by former CBI Director R. K. Raghavan had issued summons to Modi early this month in connection with the complaint filed by Mrs.Zakia Jafri- the widow of former Congress MP Ehsan Jafri who was killed in the Gulberg Housing society with 68 others.<br/><br/>The Congress has criticised Gujarat Chief Minister Narendra Modi for not showing up before the SIT. Party spokesperson Abhishek Singhvi said in New Delhi that it was contemptuous and showed that Modi loves to hide. The BJP remains non-committal on whether Chief Minister Narendra Modi would depose before the Special Investigation Team. BJP spokesperson Rajiv Pratap Rudy said that the government of Gujarat has made it clear that it shall act as per the law.
