Govt moves Custom Amendment & Validation Bill 2011 in Lok Sabha

The government moved Customs (Amendment and Validation) Bill 2011 in Lok Sabha on Friday. The bill aims at amending the clause 34, section 2 of the Act with retrospective effect. It will enable the officers of Customs (Preventive) and officers of Revenue Intelligence to act as a competent authority for assessment of goods and issue of a notice even if they are not specifically assigned to such duty.Moving the bill for consideration, the Finance Minister Pranab Mukherjee said, the situation has arisen due to a recent judgement by the Supreme Court that only a customs officer who has been specifically assigned for assessment and re-assessment in the jurisdiction area is competent to issue a notice for the demand of duty as a proper officer. The discussion on the bill will be taken up on Tuesday.
