The government today introduced a new bill in the Lok Sabha today proposing to allow Indian legal heirs to inherit the properties of relatives who migrated to Pakistan. The Bill was introduced by the Home Minister Mr. P. Chidambaram. Under the provisions of the Bill, the enemy property will be divested only to the owner, or its lawful heir and continue to vest in the custodian till it is divested by the Centre. The proposal for fresh amendments provides for ensuring that the enemy property shall continue to vest in the custodian till it is divested by the Central government. According to the provisions of the Bill, if the owner is dead it will go to any lawful heir but the claimant will have to establish that he or she is the rightful heir. According to the amendments, if the enemy property was divested from the custodian before 2nd of July this year, it will stand transferred to and vest or continue to vest in the custodian. The new Bill is entitled The Enemy Property Amendment and Validation Second Bill, 2010. It seeks to amend the four decade old enemy property Act of 1968 and the public premises eviction of unauthorised occupants’ act of 1971. AIR correspondent says that the earlier amendment bill replacing the ordinance on the issue, was objected to by some opposition parties and the government had decided to withdraw the bill and bring a fresh bill.
