FM says courts in the country always upheld & defended right to free speech & expression

Finance Minister Arun Jaitley today said, courts in the country have always upheld and defended the right to free speech and expression guaranteed under the Article 19 of the Constitution.. Addressing a session at the Times LitFest in New Delhi this evening, Mr Jaitley said, following Independence, the judicial system in the country was weak as it was overpowered by the governments but many landmark judgements resisted the government's authority. <br/><br/>Speaking about five legal cases that have shaped Indian democracy, the Minister said the Kesavananda Bharati versus State of Kerala case was the most important case in history as the Supreme Court outlined the basic structure of the Indian constitution. Jaitley also said, Maneka Gandhi versus Union of India was another case, where Ms Gandhi's passport was impounded by the state, that highlighted the supremacy of fundamental rights in the country. Mr Jaitley said that the judgement on gay sex should be reconsidered by the Supreme Court. He said, Apex Court's 2014 verdict banning gay sex is not in accordance with evolving legal jurisprudence. <br/><br/>Replying to a query, the Minister said, it is not fair to tamper with right to propagate religion under Article 25. On a query on reservation, Mr Jaitley said, there is a need for roadmap for the next 50 years especially while considering the case of the Tribals of Central India.
