The Bangladesh Supreme Court today modified the High Court’s order which had ruled that fatwa is illegal by ruling that Fatwa on religious matters only may be given by the properly educated persons which may be accepted only voluntarily. Delivering its verdict on an appeal against the High Court’s ruling declaring fatwa as illegal, the seven member bench of the appellate division headed by Chief Justice A.B.M Khairul Haque said that fatwa on religious matters may be given but it should not be enforced by any coercion or undue influence in any form is also forbidden. The Bangladesh Apex Court has also ruled that no punishment including physical violence or mental torture in any form, can be imposed or inflicted on anybody in pursuance of fatwa. In addition to this the court in its verdict has also asserted that no person can pronounce fatwa which violates or affects the rights or reputation or dignity of any person which is covered by the law of the land.
