The Election Commission delivered a historic verdict by disqualifying the Bahujan Samaj Party UP MLA. Umlesh Yadav for three years from contesting any election for Parliament, State Legislature, Assembly or Legislative Council.Quoting Commission sources our Lucknow correspondent reports that full Commission headed by the Chief Election Commissioner Dr. S.Y. Quraishi has passed this order on Thursday. She was disqualified under section 10A of the Representation of Peoples' Act 1951 for suppressing expenditure which was spent for issuing advertisement. This is the first case of action against a politician for 'Paid News' syndrome. The Commission has said that by suppressing expenditure on paid news and filing an incorrect or false account, the candidate is guilty of not merely circumventing the law relating to election expenses but also of resorting of false propaganda by projecting a wrong picture and defrauding the electorate.It was alleged that the Ms. Yadav had not mentioned expenses made by her for publishing paid news items in two Hindi Dailies during Assembly elections in 2007. The Commission has said that instead of admitting her failure, she has denied to have filed an incorrect account and defended her act of having filed an incorrect account.AIR correspondent reports that Ms. Yadav was elected from Bisauli Assembly Constituency in Badayun district as Rashtriya Parivartan Dal candidate. Later, her party was merged with ruling BSP in UP.
