Drugs ban: Partial relief from HC for Wockhardt, Glaxo & Griffon

Delhi High Court today stayed the ban on some fixed dose combination drugs of Glaxo SmithKline, Wockhardt and Laboratories Griffon but said action against their sale could be taken in the absence of a valid sale and marketing licence. <br/><br/>Justice Rajiv Sahai passed the order after the government said, the three companies had obtained licence from state licensing authorities bypassing the national regulatory body, Drugs Controller General of India. <br/><br/>The high court said the government was free to take action against sale of these medicines under any other law available to it, if there was no valid licence for their sale and marketing.<br/><br/>The court also issued notice to the government on a plea by 22 health care companies challenging a March 10 government notification banning over 300 FDC drugs and listed the petitions for hearing on March 21.The FDC drugs including cough syrup compositions were banned on the ground that they involve risk to humans and safer alternatives were available.
