Disqualification of 11 BJP MLAs: Karnataka HC to continue hearing

A senior judge of Karnataka High Court, Justice V G Sabhahit heard on Wednesday the matter related to disqualification of eleven BJP MLAs. Advocates on behalf of 11 BJP MLAs namely K G Raghavan, B V Acharya and Ravi Verma Kumar submitted their argument. Justice V G Sabhahit was appointed as third Judge after a Division Bench comprising of Chief Justice J S Khehar and N Kumar gave a split verdict on one one particular aspect of the case pertaining to voluntary resignation of BJP MLAs. The disqualified BJP MLAs had appealed to the Court, when the Speaker K G Boppaiah had disqualified them under Anti Defection Law when they withdrew support to the BJP Government in Karnataka. The hearing will now continue tomorrow.The 10th Schedule and para 2(1) A with reference to Anti Defection Law under the Constitution was largely interpreted by the Lawyers representing disqualified BJP MLAs in the court on Wednesday. The role of the CM, Speaker and the Governor was also discussed. The Lawyers basically argued that the rebel BJP MLAs just expressed their dissent against what they said was the corrupt governance of present Chief Minister. They argued that the MLAs are royal members of BJP and not willing to join any other party to form Government. Their intention was not to destabilize the Government but to seek change of leadership. Based on this, they defended the actions of the petitioners saying that the provision of the anti defection does not apply to them. Former Attorney General Soli Sorabjee and Lawyer Satyapal Jain representing the Chief Minister of Karnataka are likely to submit their arguments on Thursday.
