Delhi HC holds LG as administrative head of National Capital Territory

Delhi High Court today held that Lt. Governor is the administrative head of the National Capital Territory.<br/><br/>The court said AAP government's contention that LG is bound to act on advice of Council of Ministers is without any substance and cannot be accepted.<br/><br/>A bench of Chief Justice G Rohini and Justice Jayant Nath dismissed AAP Government's plea challenging the Centre's May 21, 2015 notification giving absolute powers to LG in appointing bureaucrats in the national capital.<br/><br/>AAP Governement had contended that the notification barring Anti Corruption Bureau, ACB from proceeding against Central Govt employees is neither illegal nor unsustainable.<br/><br/>Ruling that the Service matters were outside the jurisdiction of Delhi Legislative Assembly, the court said that LG exercising the powers is not unconstitutional.<br/><br/>It also held as illegal AAP govt's order appointing Commission of Inquiry in the CNG fitness scam and DDCA scam since the same was issued without concurrence of LG.<br/><br/>The AAP government today said it will challenge today's High Court order holding that the Lieutenant Governor is the administrative head of the National Capital Territory as it undermined the powers of the council of ministers given by the Constitution.<br/><br/>Delhi Home Minister Satyendar Jain today said that Delhi Government will move the Supreme Court against the High Court verdict. The Minister alleged said that the Kejriwal government has been prevented by the Centre from taking any action against corruption since it was formed. <br/><br/>BJP today said Delhi High Court's verdict that Lieutenant Governor is the administrative head of the National Capital, is the reiteration of the Constitutional provisions. <br/><br/>It said that some people were trying to ignore this fact knowingly. Reacting to the Court's direction dismissing Aam Aadmi Party's contention that LG is bound to act on advice of Council of Ministers, senior party leader and Union Minister Dr Harsh Vardhan said he has still doubt that such people will accept this legal provisions. <br/><br/>He said truth has prevailed in the matter where the court has also termed the city government's order appointing Commission of Inquiry in the CNG fitness scam and DDCA scam as illegal. <br/><br/>The Minister said the truth cannot be hidden by abusing and sloganeering.

The court said AAP govt's contention that LG is bound to act on advice of Council of Ministers is without any substance and cannot be accepted.<br/><br/>It said May 21, 2015, notification of Centre barring Anti Corruption Bureau, ACB from proceeding against Central Govt employees is neither illegal nor unsustainable. <br/><br/>Service matters fall outside the jurisdiction of Delhi Legislative Assembly and LG exercising the powers is not unconstitutional.<br/> <br/>The High court also held as illegal AAP govt's order appointing<br/>Commission of Inquiry in the CNG fitness scam and DDCA scam<br/>since the same was issued without concurrence of LG.<br/><br/>AAP govt's counsel in the court said they will immediately file<br/>an appeal against the verdict.
