Delhi Chief Minister Arvind Kejriwal has asserted that the draft Jan Lokpal Bill approved by his Cabinet is constitutional. In a letter to Lt. Governor Najeeb Jung, Mr Kejriwal questioned how the Lt. Governor sought opinion from Solicitor General about the bill which reached his office only last evening and shortly there after it was leaked to the media. He said, if it was necessary to seek opinion, then Mr Jung should first have discussed the matter with him.
The Chief Minister clarified that when the draft bill was prepared by a high-powered committee after seeking opinion from every department of the city government, then how did the Solicitor General declare that the bill is unconstitutional.
Solicitor General Mohan Parasaran has insisted that the Lieutenant Governor's prior approval is necessary to pass the Bill.
Delhi Pradesh Congress Committee, DPCC, President Arvinder Singh said his party is not against the Bill but it should be done in a legal way.
Congress's assertion on the issue came after the AAP government made it clear that the Bill will not be sent to either Home Ministry or the Lt Governor for approval before tabling in the Assembly.
BJP leader Harsh Vardhan has also said his party strongly favours Jan Lokpal Bill but will oppose any move by the Delhi government which violates the Constitution.
Delhi assembly speaker Maninder Singh Dhir also feels the bill does not require a nod from the President or the Governor or the Lieutenant Governor.
