The government today said that some cases have come to its notice where Indian products were being copied and sold in china and also exported from China to other countries. This was informed by Minister of state for Commerce, Dr D. Pundeshwari in a written reply in the Rajya Sabha. She made it clear that no specific case of such counterfeit products being sold in the Indian market has come to the notice of the Government. She said some complaints involving copyright and trademark violation against Indian brands and products by the Chinese companies were received. The Minister said that onus of trademark registration and protection in China lies on the enterprises concerned. In case an instance of illegal copying of brands or trademarks or violation of copyrights is reported, the enterprise concerned has to seek redressal through the existing mechanisms in China. As per the extant rules in China, the individual enterprise has to file a case in relevant forum by hiring a law firm.Embassy of India in Beijing has not noticed any such case where the Indian company pursued the case by hiring a law firm.
