Center directed to provide necessary travel documents to Surrogate twins

The Supreme Court today directed the Centre to provide necessary travel documents to the surrogate twins of a Germen couple, born of an Indian
woman, to enable them to go back to their country. A Bench headed by Justice G S Singhvi, however, stayed the Gujarat High Court order directing grant of Indian citizenship to the twins.

The direction was passed by the Bench on the plea of a German couple Jan Balaz and Susane Lohle seeking Indian citizenship for their kids born in February 2008 through the surrogate mother Martha Immanual Khristy of Gujarat. In their plea, the German couple had contended that in the absence of Indian citizenship, the twins would not be allowed entry into Germany which does not recognise surrogacy.

The couple had claimed that once the twins are accorded Indian citizenship, they would be entitled to passports, facilitating their entry into Germany. Earlier, after the passport authorities turned down their plea, the couple moved the Gujarat High Court, which on November 11 directed the Centre to grant Indian citizenship to the couple. The High Court had taken the view that since the twins were born to a surrogate Indian mother they were entitled to the country's citizenship.
