The Bombay High Court will deliver its verdict today on confirmation of death sentence awarded to Ajmal Kasab, the lone surviving terrorist of the 26/11 Mumbai terror attacks. On 3 May 2010, a special court at Mumbai's high-security Arthur Road jail convicted Kasab of murder, abatement to murder, waging a war, criminal conspiracy and committing terror acts. On 6 May 2010, the same trial court sentenced him to death on four counts and to a life sentence on five other counts. Kasab had come to Mumbai via the Arabian Sea route with nine other gunmen, all of whom were killed during the 60-hour operation by combined security forces. 166 people were killed in the massacre while several others were injured. Hearing in the confirmation case began on October 18, 2010, after Kasab challenged the lower court order. A Division Bench of Justices Ranjana Desai and R.V More heard the confirmation case and arguments. The proceedings lasted over three months wherein the prosecution presented evidence against Kasab. Public Prosecutor Ujjwal Nikam opposed part acceptance of Kasab's confession by the trial court. He said either it had to be accepted in its entirety or rejected fully. Nikam sought to corroborate witness testimonies. Defence lawyer Amin Solkar sought retrial saying Kasab was denied a fair trial. He claimed that important witnesses were not examined. While he did not deny the incident of 26/11, he raised doubts over witness testimonies. The state has arranged for video conference link in the court for Kasab today in case he wanted to hear the verdict from the high security Arthur Road Central jail where he is lodged. The High Court today will also give its ruling on the appeal filed by Maharashtra government challenging acquittal of co-accused Faheem Ansari and Sabauddin Ahmed in the same case. The trial court had set them free on the ground that evidence against the duo was doubtful. Meanwhile, security has been tightened in and around the High Court and special passes have been issued to the media for entry to courtroom 49.
