Bombay High Court today asked Ministry of Defence, MoD, to respond within two weeks to Maharashtra government's stand that CBI cannot probe Adarsh scam. Maharashtra government had filed an affidavit in the Bombay High Court saying that there is no need of a CBI investigation into the Adarsh Housing Society scam. The state government's affidavit said that the CBI has no jurisdiction over the case as the judicial commission appointed by Maharashtra government has already submitted a report stating that the land where the Adarsh building stands belongs to the state government and not the Defence Ministry. It further said that as the land belongs to state, the power of investigation lies with the state police.
