The Bombay High Court has allowed the Election Commission to hold bye-election to a vacant post in the Legislative Council, for which Maharashtra Chief Minister Prithviraj Chavan is contesting. The Election Commission will now issue a notification regarding the bye-election. Chavan, who took over the reins of Maharashtra on November 11, 2010, is required to be elected as member of the State Legislature within six months failing which he would cease to be a minister under provisions of the Indian Constitution. The EC had approached the High Court on Monday seeking permission to declare the bye-elections which would be completed by May 10. The elections are necessary for Chavan to continue after May 11.
