Andhra Pradesh High Court has ruled that Article 3 cannot be contested as it is the fundamental structure of the Constitution. A Division Bench of the High Court comprising Chief Justice Kalyan Jyothysen Gupta and Justice K C Bhanu gave the ruling while dismissing a PIL seeking direction to the Central Government not to carve out separate Telangana State.
It said the issue is under the preview of Parliament alone. The petitioner had urged the court to direct the centre not to use article 3 of the Constitution as special provisions in education and employment under article 371 (D) are in force in the state.
