The Allahabad High Court has come down heavily on incarceration of a rape victim in jail and ordered the Uttar Pradesh Government to release unconditionally Sheelu Nishad lodged in Banda jail in alleged theft case. The minor girl was allegedly raped by a ruling BSP MLA Purushottam Naresh Dwivedi, who has been sent to jail for 14 days under judicial custody. Taking Suo Motu cognizance of the case on the basis of a news item published in a newspaper the bench comprising Justice Imtiaz Murtaza and Justice S. C. Agarwal ordered the relase of the girl from jail and fixed Tuesday for next hearing. It asked the state government Adovacte to produce the case diary of victim girl and report of the CB-CID in the case. Besides, the Court also directed the Superintendent of police of Banda to provide adequate security to the girl and her family member’s. Meanwhile, the girl has been released from the jail. Chief Minister Mayawati has said that action will be taken against policemen involved in harassing the minor who was charged with theft apparently as part of a conspiracy.
